PARK REGULATION GERLOS

A. GENERAL PROVISIONS

1. Schilift-Zentrum-Gerlos GmbH operates the parking facilities at the Isskogelbahn valley station. Use of the parking spaces is only permitted after a usage agreement has been concluded. By paying the parking fee via the Parkster app or by purchasing a parking ticket, the user enters into a usage agreement with the operator.
2. By entering or parking a vehicle, users fully accept these terms.
3. Parkster GmbH acts solely as a data processor under Art. 4 para. 8 GDPR.

B. SUBJECT OF AGREEMENT

1. The contract entitles users to park a roadworthy and traffic-safe vehicle in a suitable, available space. Any restrictions (e.g. reservations, time limits) must be strictly observed. Marked disabled parking spaces may only be used by people with a valid and clearly visible disabled parking permit under §29b StVO or a disability pass with the note “unreasonable use of public transport.”
2. Local traffic regulations apply. Speed limits must be observed.
3. No surveillance or safekeeping of vehicles or items is part of the contract—only provision of parking spaces.

C. FEES, OPERATING HOURS

1. Parking is subject to fees, payable in advance. Valid tariffs and operating hours are posted.
2. Parking spaces are only accessible during opening hours. Outside these times, access and presence are prohibited.
3. Payment is possible via the Parkster app, card payment at the machine, or in cash at the valley station ticket office during opening hours. Fees must be paid immediately after parking. Refunds are not possible.

D. LIABILITY

1. Use is at your own risk.
2. The operator is not liable for third-party behavior (e.g. theft, damage) or force majeure.
3. No liability for vehicle contents.
4. Operator is liable only for damage caused intentionally or by gross negligence.
5. Vehicles must be locked and secured.
6. Instructions from staff must be followed.
7. Damage must be reported before exiting. Legal reporting obligations remain unaffected.
    

E. RULES OF CONDUCT

1. Vehicles must be roadworthy and legally permitted.
2. Stay in the parking area is only permitted for the time needed to park or retrieve the vehicle.
3. Sleeping or resting in the parking area or in the vehicle is prohibited.
4. Prohibited actions include:
   • Storing any items, especially flammable or explosive substances;
   • Maintenance, refueling, battery charging, draining fluids;
   • Running or testing engines, honking;
   • Parking leaky or defective vehicles, or those without valid inspection;
   • Parking without license plates or valid replacements without permission;
   • Parking in driveways, exits, walkways, in front of doors;
   • Leaving items outside the vehicle;
   • Littering. Cleaning costs are charged to the offender.
5. Vehicles must be parked without blocking others.
6. Camping is strictly prohibited.

F. ELECTRIC VEHICLES

1. Charging of electric vehicles is partly available but not guaranteed.
2. Only electric/hybrid vehicles may use marked charging spots, and only during charging.

G. VERHALTEN IM BRANDFALL

1. In case of fire or smoke: alert fire department, trigger alarms if available. Report: WHERE (address), WHAT (car, building), HOW MANY injured, WHO calls. Follow posted fire instructions.
2. Warn endangered persons, evacuate where possible. Only attempt to extinguish if safe. Leave the area on foot immediately.

H. SANCTIONS, RIGHT OF RETENTION

1. Without valid authorization or if rules are violated, a contractual penalty applies in addition to parking fees.
2. Operator may tow vehicle at owner's cost and take legal action.
3. Enforcement costs are borne by the customer.
4. Operator retains the right to hold the vehicle until claims are settled.
5. Blocking removal is allowed until a security deposit is paid.

I. VIDEO SURVEILLANCE

1. The operator uses video for site protection, compliance, and crime prevention.
2. Legal compliance with GDPR and DSG ensured.
3. No monitoring of vehicles; no liability for this.

J. DATA PROTECTION, FINAL PROVISIONS

1. Use of services involves personal data processing.
